Tapesearch API Terms & Conditions

Welcome to the Tapesearch API. We're excited to see the innovative applications you create using our data. However, please keep in mind the following Terms & Conditions:

You can not use the Tapesearch API to create an application or service that competes directly with Tapesearch’s core products.
The term “Tapesearch API” describes all programmatically accessible services that return data and metadata related to podcasts listed on Tapesearch. This includes but is not limited to the REST API and all web-based services.
Reselling direct access to the API is not allowed.
Applications and integrations with the API must not store the data server-side. Caching for a limited time is perfectly admissible. Responses must be served timely to your end users. You may store and use the data temporarily for analysis, inference, or other qualitative actions.
We reserve the right to revoke access to any application that breaks these terms.
Please contact us if you have any questions. We may be able to offer an exemption to these rules in certain circumstances.

1. Data Accuracy

While we strive to ensure the accuracy of the data provided through our API, we cannot guarantee its correctness. Users should independently verify any information before relying on it.
The transcriptions provided through our API are likely to be incomplete and incorrect. These are approximations and have not been verified with the podcast creators.

2. Prohibited Use of Data and API

Prohibition of Data Harvesting: Users are strictly prohibited from engaging in any form of data harvesting, including but not limited to, scraping, crawling, or systematically downloading data provided through the Tapesearch API with the intent to replicate, duplicate, or clone Tapesearch's database. This includes using automated systems or software to extract large amounts of data from our service for commercial or non-commercial purposes without explicit written permission from Tapesearch.
API Abuse: Abusing the Tapesearch API, including but not limited to, exceeding rate limits, attempting to circumvent API limitations, unauthorized access to or alteration of API data or services, or using the API in a manner that negatively impacts the stability and performance of Tapesearch's services, is strictly prohibited. Users must adhere to all operational guidelines and rate limits as specified by Tapesearch to ensure fair and efficient use of the API for all users.
Creative and Responsible Use: While Tapesearch encourages the innovative and beneficial use of its data through the API, such use must be responsible and in full compliance with these Terms & Conditions. Users are encouraged to develop valuable tools and services that enhance user experience and provide meaningful insights, provided that such use does not infringe upon Tapesearch's intellectual property rights or lead to unauthorized replication of Tapesearch's services.

3. Consequences of Prohibited Use

Enforcement Actions: Tapesearch reserves the right to take any and all appropriate actions against users found to be in violation of these prohibitions, including, but not limited to, temporary or permanent revocation of API access, legal action for injunction, damages, and restitution, and reporting of violations to law enforcement authorities as deemed necessary.
Notification and Appeal: Users suspected of violating these terms will be notified of the specific nature of the violation and given an opportunity to cease the prohibited activity or dispute the allegation. Tapesearch reserves the right to unilaterally terminate API access if the user fails to comply or adequately address the concerns raised by Tapesearch.
Liability for Misuse: Users agree to be fully liable for any direct or indirect damages, losses, or expenses incurred by Tapesearch or third parties as a result of the user's violation of these terms, including but not limited to costs associated with the enforcement of these terms, legal fees, and any compensation for intellectual property infringement.

4. Clarification of Permissible Use

License to Use Data: Subject to these Terms & Conditions, Tapesearch grants users a non-exclusive, non-transferable, revocable license to access and use the data provided through the Tapesearch API for the purpose of developing applications that are beneficial to the end-users and do not replicate or compete directly with Tapesearch's core offerings. Any other use of data not expressly permitted herein is prohibited without prior written consent from Tapesearch.
Intellectual Property Rights: Users acknowledge that all intellectual property rights in the data, API, and any other resources provided by Tapesearch are owned by its original creators and property rights owners, Tapesearch, or its licensors. Use of the API does not grant users any rights to Tapesearch's intellectual property except for the limited license to use the data as expressly permitted under these terms.

5. API Limitations

The Tapesearch API may have rate limits to ensure fair usage and to protect the service from abuse. You must respect these limits and not attempt to circumvent them.

6. Privacy and Data Protection

The API is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

Tapesearch shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the API or for any other claim related in any way to your use of the API.

11. Indemnification

You agree to indemnify and hold harmless Tapesearch and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the API, your violation of these Terms & Conditions, or your violation of any rights of a third party.

12. Governing Law

These Terms & Conditions and your use of the Tapesearch API shall be governed by and construed in accordance with the laws of the jurisdiction in which Tapesearch is based, without giving effect to any principles of conflicts of law.
