So Mayo we're recording this on Thursday morning. It's about 9 a.m. Eastern time and by the time most people are listening to this barring any last minute developments the Apple Watch Series 9 and Apple Watch Ultra 2 will be

0:15.2

gone from Apple's website. You could say the clock is literally ticking. The most

0:21.7

accurate time piece in the world. Down to 50

0:24.8

milliseconds this watch is about to be banned. So this this starts years ago

0:31.0

Apple's long-running patent dispute with the medical device company, Mossimo,

0:38.0

and they've been kind of battling it out in multiple different court cases, with Mossimo arguing that Apple infringes on some of its patents related to

0:45.7

blood oxygen technology. And of course the Apple Watch added blood oxygen features with the

0:51.9

Series 6 in 2020. So this has been going on for a

0:56.8

while and it's kind of culminated in this ruling from the International Trade

1:01.5

Commission that was first handed down in January, saying

1:04.9

that Apple did indeed infringe on two of Mossimo's patents covering five different instances

1:10.6

of patent infringement. So that was January then in October the ITC upheld its decision and basically

1:18.1

kicked the can to the Biden administration starting the clock on a 60-day presidential review period, during which the

1:26.2

Biden administration can step in and veto the ITC's decision.

1:31.2

But so far, again, it's Thursday, December December 21st the Biden administration has opted not to do that and

1:36.8

their deadline for doing that would be December 25th so Merry Christmas to Apple

1:42.4

So that kind of leaves us where we are right now 5th, so Merry Christmas to Apple.

1:43.4

So that kind of leaves us where we are right now.

1:46.3

Apple will remove the Series 9 and the Ultra 2

1:49.0

from its website today at 3 PM Eastern time and from its retail stores at the end of the day on

1:56.5

December 24th. And this is only in the US. Only in the US, correct?

2:01.3

Yeah. Europeans and other countries, the watches are still on sale, but US is gone from the website by the time this episode is out.
