podcast. Verdict means to speak the truth.

I took a lot of Latin.

That doesn't mean I remember a lot of Latin, but I took it for a number of years.

I think, quite literally verdict means to speak the truth

which is a beautiful thing upon which to reflect objective truth. The question, however, is how do we get there? In reality,

our criminal justice system is an adversarial one where despite what you may hear,

despite what some of my friends who are defense attorneys may want to tell you, it is not a joint pursuit of the truth.

I mean, think about it.

If you really wanted the truth, you would want to hear from every single witness who had information.

Our system goes to great lengths to make sure that doesn't happen.

Defendants don't ever have to talk. Defendants have the right to remain silent.

In fact, if you ever sit in a criminal trial, judges spend a lot of time telling the jury.

You can't even think about the fact that someone would not walk 12 or 15 steps to the

witness stand and tell you that he or she did not commit murder or kidnapping or bank robbery or

fill in the blank.
