I want to make a quick observation as we are heading into the final stretch of this year's election cycle.

There's been talk lately of the Electoral College and why we have it.

Republicans have lost the popular vote, I think seven out of the last eight presidential races, twice in our recent past,

Democrats won the popular vote and yet lost the presidency.

And it may well happen again in a month we'll have to see.

So you know the curse of being a lawyer is you try to understand where the other side is coming

from and hope that they do the same with you.

I am sure it is frustrating to get the most number of votes cast and yet not win an election.

But we have to know why things are the way they are. Truth be told,

there might well never have been a United States of America without the compromise that led to the Electoral College.

Big states back then wanted the popular vote to carry the day.

Smaller states felt like they would be out of luck. And therein lies the

initial point. We're a collection of states. That was the intent from the beginning.

And those states were supposed to be powerful in their own right,

which is why we have the ninth and tenth amendments

to the Constitution.

Part of our Bill of Rights,

important enough to be included in the first 10.
